Athletic Trainer Finder - Terms of Service

Welcome to Athletic Trainer Finder! By using our platform, you agree to the following Terms of Service ("Terms"). Please read them carefully before accessing or using our services.

1. Acceptance of Terms

By accessing or using Athletic Trainer Finder (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform immediately.

2. Platform Overview

Athletic Trainer Finder provides a digital platform to connect event organizers seeking athletic training coverage with independent athletic trainers. Athletic Trainer Finder is not an employer of the athletic trainers and does not provide direct athletic training services.

3. Independent Contractor Relationship

For Athletic Trainers:

You acknowledge that you are an independent contractor and not an employee of Athletic Trainer Finder.
You are responsible for maintaining proper certifications, licenses, and liability insurance as required by law.
You are responsible for your own taxes and financial reporting. Athletic Trainer Finder does not provide benefits or tax withholdings.
You assume full liability for your professional services and agree to hold Athletic Trainer Finder harmless from any legal claims or disputes.

For Event Organizers:

You acknowledge that Athletic Trainer Finder is a third-party platform and does not employ or supervise the athletic trainers listed on the site.
You are responsible for vetting the qualifications and credentials of any athletic trainer you engage through the platform.
You assume full liability for your event and agree to hold Athletic Trainer Finder harmless from any injuries, medical incidents, or disputes arising from services provided by an athletic trainer booked through the platform.
You confirm that your organization holds appropriate liability insurance for hosting events requiring medical coverage.

4. Payment and Fees

Athletic Trainer Finder may process payments through Stripe or other third-party payment processors.
Athletic trainers choose to accept rates, and Athletic Trainer Finder may charge a service fee on transactions processed through the platform.
Payments processed through Stripe may be subject to Form 1099-K reporting per IRS guidelines.
Any disputes regarding payments should be addressed directly between the athletic trainer and the event organizer.

5. Code of Conduct

All users must adhere to professional and ethical conduct, including:

Providing accurate information in profiles and job postings.
Honoring accepted job commitments unless extenuating circumstances arise.
Communicating respectfully and professionally through the platform.
Abiding by all applicable laws, licensing requirements, and professional standards.

Athletic Trainer Finder reserves the right to suspend or terminate accounts found in violation of these standards.

6. Limitation of Liability

Athletic Trainer Finder is a neutral marketplace and shall not be liable for:

Any injury, loss, or damage incurred as a result of hiring an athletic trainer through the platform.
Any disputes, misrepresentations, or contractual breaches between athletic trainers and event organizers.
Any failure or delay in processing payments due to third-party payment processors.

Users agree to indemnify and hold harmless Athletic Trainer Finder from any claims, damages, or legal fees arising from their use of the platform.

7. Privacy Policy

Athletic Trainer Finder collects and processes user data in accordance with our Privacy Policy. By using the platform, you consent to our data collection practices.

8. Modifications to Terms

Athletic Trainer Finder reserves the right to modify these Terms at any time. Continued use of the platform after updates constitutes acceptance of the revised Terms.

9. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of Vermont and any disputes shall be resolved through binding arbitration in Vermont.
